Terms of use for www.trustpilot.co.uk and the Trustpilot toolbar:
The terms of use listed below (hereafter simply referred to as ‘terms’) includes use of services, including the possibility to contribute with postings (hereafter simply referred to as ‘services’) on Trutspilot’s website, www.trustpilot.co.uk (hereafter simply referred to as ‘the website’) as well as the Trutpilot Toolbar. By using services and/or the Trustpilot Toolbar you accept that you must abide to the terms. Under ‘terms’ the words ‘we’, ‘us’ and ‘our’ refer to Trustpilot.
The terms are applicable to all users of the website, services and the Trustpilot Toolbar. If you do not wish to accept the terms you are not allowed to use the website, services and Trustpilot Toolbar.
SERVICES
1 Registred user
1.1. To get access to, and make full use of the services you must register as user (registred user) on the website.
1.2. While registering, you must choose a password to use along with your e-mail address when you log on to the website. The password is personal and may under no circumstances be passed on or in any other way made available to others. It is your responsibility to make sure that the password is not obtained by third parties. Should you find out that the security of the password has been, or potentially could be, compromised, you are obligated to inform us.
1.3. We reserve the right to delete your registration and thereby your access to making use of the services, should you viloate the rems.
1.4. Moreover, we reserve the right to delete your registration at any time and without any warning or explanation. Our exemption of liability will, in such cases, be unlimited.
1.5. It is not permitted to seek access to the services unless you are registred as user.
2 Contributions from registred users
2.1. All material, information, reviews, mentions and any other form of communication (hereafter all referred to under the term ‘contributions’) that are received from registred users via the website will be regarded as non-confidential, non-exclusive and will not entitle the sender to royalties or any form of compensation. We are free to use any such material, information etc.
2.2. Registred users are responsible for the content of the contributions they publish on the website.
2.3. Registred users may not publicise contributions on the website that has
*Marketing characteristics or purposes
*Sexist or racist characteristics or content or that condescends ceratin people or groups.
*Content, including copyrightet material, that the registred user neither has the rights nor the permission to make use of.
*Unloyal or unlawful purpose or content
2.4. Contributors are in all cases responsible for the legality of the contribution. If a violation of point 3.3. is found, the contribution will be deleted immediately. Furthermore, we will, depending on the nature of the violation, orientate the violated part and/or inform the authorities about the contribution, because these parts will hereafter be left to assess whether the violation prompts civil- and/or criminal prosecution.
2.5. The registred user must guarantee that Trustpilot is held indemnified for any demand that may be rasied by a third party against Trustpilot as a consequence of the registred user’s violation of point 3.3., the terms as a whole or the valid practice of law.
2.6. We reserve the right to delete contributions at any time and with no warning or explanation.
TRUSTPILOT TOOLBAR
3. License and use
3.1. By accepting the terms and the following installation of Trustpilot Toolbar you obtain the license to use Trustpilot Toolbar. The license is personal and nontransferrable.
3.2. Downloading or installing more than one copy of Trustpilot Toolbar is not permitted.
3.3. Trutpilot Toolbar is activated after installing and will hereafter be automatically active upon opening the browser MS IE. You are free to deactivate and activate Trutspilot Toolbar. No data will be exchanged between you and us if Trustpilot Toolbar is deactivated.
3.4. Your license to use Trustpilot Toolbar will terminate immediately, should you violate the terms. In this case, you are obligated to delete Trustpilot Toolbar from your system. To the extent possible, we will prevent you from using Trutspilot Toolbar.
3.5. We reserve the right to remove your license to use Trutspilot Toolbar at any time and with no warning or explanation.
3.6 We reserve the right to demand compensation for misuse of Trustpilot Toolbar in the case where violation of the terms or valid practice of law has occurred.
GENERAL
4 Rights
4.1. All company names, brands and other company trademarks and the website belongs to either Trustpilot or third parties and can only be used for business purposes after a preceding permission from us or third paries respectively. Rights to our free use of contributions are nontransferrable, without time limit and with no territorial limits towards us, upon sending the contribution to us.
4.2. The website’s content such as, but not limited to, text, graphics, icons, pictures and software, inclduing Trustpilot Toolbar, is the propery of either us or third parties and are protected by Danish law in accordance with the copyright law, trademark law, marketing law among others.
4.3. Unauthorized copying, distribution, public showing or any other copyrighted and relevant use of the website, or parts of the website, including Trutspilot Toolbar, is illegal in accordance to Danish law and result in civil as well as criminal prosecution.
4.4. Downloading or other digital copying of the website’s content, including Trustpilot Toolbar or parts hereof, is only permitted for personal non-commercial purposes unless otherwise agreed with us.
5 Personal information
5.1. In connection with the use of the services, we register the information given to us upon user registration or the information the registred user later adds.
5.2. In connection with the use of Trustpilot Toolbar we register the following information for every website you visit while signed in to Trustpilot Toolbar:
*URL
*Time of visit
*Your version of Trustpilot Toolbar
5.3. The registred information, as mentioned in point 5.2., will not be passed on to third parties and will thus only be used by us and with the sole intention of:
*Facilitating use of Trustpilot Toolbar
*Preventing misuse of the website, including identification and barring of robots, who may harm the website and cause inconvenience to users.
*Offering you updates of Trustpilot Toolbar. Thus, Trustpilot Toolbar will periodically send information to our servers about what version of Trustpilot Toolbar you are using. If you are not using the latest version, we will automatically offer you an update.
5.4. To ensure that users get the best possible experience from using Trustpilot Toolbar and the website, we process information about search behaviour and other user behaviour on Trustpilot Toolbar and the website, including the total number of visits to the website. The information will, however, not be processed in a way that can trace the behaviour to specific users. These statistical and non-personal information can be transferred to third parties.
5.5. Cookies are used on the website to monitor what parts of the website the user’s browser has previously visited and enables ud to adjust the website’s content accordingly. However, we do not process information, gathered by cookies in this manner, that can connect the user behaviour with specific users.
5.6. By signing up as registred user and installing Trustpilot Toolbar, you consent to our aforementioned processing of personal data.
5.7. Our processing of personal data is carried out according to the law of personal data.
Registered users can contact us if they request information about what data that are processed about them or if they wish to have the information deleted or rectified. Furthermore, registred users can at any time withdraw their consent, which can happen by contacting support@trustpilot.com. Withdrawal of consent will be considered as request to be deleted as registred user altogether.
5.8. We have initiated a number of technical and organizational arrangements to ensure that personal information that is being processed does not delete, disappear, deteriorate or gets into the hands of unauthorized parties.
6. Disclaimer
6.1. Trustpilot does not produce or publish contributions on the website.
6.2. Trustpilot accepts no responsibility for the accuracy or completeness of contributions published by registred users on the website, including contributions of technical, external or any other cause may be changed or deleted in connection with the publication on the website or the following.
6.3. Trustpilot does not read through or edit contribution added to the website of registered users, and can in no way be held responsible for the content of these contributions. Should the contributions contain links to third parties, Trustpilot will accept no responsibility for the contents of the link in question.
6.4. Trustpilot’s recommendations and reference to concrete companies, e-shops etc. is only guiding and Trustpilot can in no way be held responsible if the guiding recommendation turns out to be incorrect, misleading or similar.
6.5. Trustpilot can in no case be made to compensate for use of the website, including loss of revenue, working loss, market interruptions, loss of goodwill or similar losses. Furthermore, Trustpilot can not be made to pay compensation or similar as a result of registred users’ use of the website.
7 Miscellaneous
7.1. Trustpilot reserves the right to revise these terms at any time, as well as the right to close the website as a result of own assessment and without warning.
7.2. If any of these terms should be deemed unlawful or void, and thereby non-enforcable, this does not affect the legitimacy or enforcement of remaining terms.
8. Choice of law and jurisdiction
8.1. This agreement is governed by Danish law and where nothing else is stated, the normal rules of Danish law applies in any reciprocal relation between Truspilot and registred users, users of Trustpilot Toolbar as well as users of the website. Any disputes and disagreements must be brought forward to the court of justice at Trustpilot’s jurisdiction.
