Wrong item delivered & refund held hostage

ordered a 400 RON dress on July 20, 2026, but received basic black t-shirts instead. Support refuses to issue my refund until FAN Courier returns the t-shirts to them, even though the parcel is stuck without AWB updates; on top of this they send a message apologizing for losing my data (my parcel with my address arrived at a different individual)

by making my refund dependent on the courier's delays, about themselves is openly violating consumer protection law

-EU Directive 2011/83/EU & OUG 34/2014 (Art. 20): The merchant bears all transit risk; the shipping issue between the store and FAN Courier is their legal responsibility, not mine, the money should have been refunded as soon as i signaled the issue (30 july, we're now 20 days after that)

-breach of contract (OUG 34/2014 Art. 13): shipping the wrong item is a fulfillment failure; Forcing me as a buyer to bear the risk of returning a wrong order before getting a refund is illegal

-unfair Commercial Practices (Law 363/2007): Withholding money over a seller error and third-party delivery delays constitutes an aggressive trade practice, motivated by the robotic customer service as "this are our internal protocols"

Holding my funds hostage over their own mistake is unacceptable. save yourself the headache and avoid this store at all costs!
