Clifton Group of Companies - the Judge says it all!

You only need to read the Judges' findings at the recent Tribunal Court Judgment dated 31st March 2023 UKFTT 00355 (TC). Excerpts: Pg 32 - 221 "We would describe MLT's (Morgan Lloyd Trustees) overall attitude to the details of all the Pension Funding Deals as cavalier....."
Pg 32 - 224 "It may be true that MLT did not intentionally circumvent the unauthorised payment rules, but it did consistently fail to apply any critical analysis to fundamental aspects of the Pension Funding Deals, which in our view amounts to at best a passive approach to the application of the rules in favour of generating fees for themselves and other members of the group."
If you've had any involvement with Clifton Consulting or Morgan Lloyd with a pension scheme, I would strongly suggest reading the Court document. HMRC had already started their investigations and raising assessments in 2011 into SASS schemes administered by Morgan Lloyd. These schemes were sold by Clifton Consulting - also known as Clifton Assets. Both companies knew there was a risk to anyone moving their pensions into these schemes but never once disclosed this to me or others I have spoken to. They sold me my scheme in 2014. When HMRC raised a protective assessment against my scheme in 2016, Morgan Lloyd stated HMRC had only just "become interested" and had "begun to raise assessments' when the evidence shows this is not the case.
Morgan Lloyd presented and confirmed in a telephone call that HMRC’s investigation was an event that had only just happened, and they did not know about HMRC's interest before they sold me the scheme in 2014. I have now found this was clearly not the case. Morgan Lloyd took, and continued to take, funds from my pension scheme to pay the legal fees they said were necessary to fight the assessment. I allege the two companies continued to advise and set up SASS schemes, knowing their clients could be at significant financial risk. I believe they worked to recruit business owners into the scheme, take their fees, and if the business got a Protective Assessment, make it out as though it’s only just happened and Morgan Lloyd was there to appeal and fight the assessment. The clients would fund the legal fees from the pension schemes. So, there was absolutely no financial risk to them. I was mis-sold this pension. I'm in dispute and have reported this to the FCA, Pension Ombudsman and Police Scotland.

I own a SASS which has been dealt with…

I own a SASS which has been dealt with very badly by Morgan Lloyd, we were advised by them and Clifton asset management to enter into a scheme where intellectual property can be used to raise money from the scheme , a protective order was placed by HMRC as they consider the advice given is not correct, it does seem to me there are a lot of business people who are in the same boat with these companies, i have got to the stage where i want to withdraw a lump under the lifetime allowance only to be told they are withholding money. please contact me if you have a similar experience via MJH executive homes ltd, we have a website.

Appalling business practice

Appalling attitude and expensive SIPP resulting in nearly ALL my pension gone AND a tax bill !!!
I was sold a SIPP where I could use the personal pension I had to fund the growth of my business.
The equity was the IP of my established business activity, and over a 10 year period would be paid back leaving me near retirement age with a reasonable pension.
Only HMRC disagreed with some .. not all of the ( very expensive ) IP valuations, by the " independent" valuers of the 300 schemes.
The Trustee Company Morgan Lloyd managing the SIPP ( next door to Clifton ) have used MY money to pay their legal bills so after Cliftons huge set up fees that just kept coming, Im left with little of the pension.
Currently in dispute.

it all started in 2014

it all started in 2014, yes 2014 I was sold a pension scheme that allowed me to draw my pension early through a secured loan facility. The security being a web site. The HMRC finally figured what they were doing and have been in legal battles ever since. The net of the net is they have frozen the pension while its all figured out. I know of at least one case where the person has not been able to access there pension while the legal wrangling goes on. Morgan Llyod appears to be part of the same group. I can't say I am impressed nor have a great many customers who have had their pensions put on hold. They even asked for us to contribute to the legal cost for a problem they caused themselves.

AVOID AT ALL COSTS !

I had a ( badly performing) ISA with this company who subsequently badgered me to take pension advice. Which i did, and was visited by an advisor. After not progressing due primarily to their extortionate pension transfer/management charges and their inability to grow a shares ISA in an equity boom, I received an email from the advisor's sales manager, rudely ( and im being kind to him ), rebuking me for wasting his and the advisors time.AVOID AT ALL COSTS...
