Fantastic website, should be used by everyone. Very telling here most of the bad reviews can't string an English sentence together!

Oh dear.... could do better but what's the point......

We truly hate to lift from any words Donald Trump might say but Marks out of Tenancy's website seems to facilitate 'fake news' at its worst.
There is no 'outing' of 'bad landlords' it seems to be simply a trolling forum without any right of response.

It could do so much better but in our opinion as both renters and accidental landlords there seems to be little care of establishing the facts. Maybe its a sad reflection of the 'age' we live in.
Don't rely on Marks out of Tenancy, do your own research.

Love their website

Love their website and what they are doing. Tenants having a voice to describe their experience with a property is vital for other tenants and a healthy thing in a free market.

The landlords who don't like it are outing themselves with their negative reviews!

Spiteful website for uneducated bullies…

Spiteful website for uneducated bullies to get revenge when you don’t pander to their humongous egos.
I’m am now seeking legal advice after my name was slandered in an untrue review about my only home! That’s right one home I do not own numerous houses or even two house like most of these pretentious angry mob like to think. The house was even selective licensed by the council and everything up to date legally but still this person was constantly looking to catch me out from day one ! He was desperately looking for someway to bring me down because he hates landlords and thinks they are all capitalist vultures. You can’t even explain the scientific logic around condensation to these people without them flipping out!
I’m left, I’m an artist ! A vegetarian and someone who has lived in the area 30 years but my tenant couldn’t except that to him I was right wing money bags out to take advantage of tenants or whatever rubbish these people think in their little minds.
Nothing I did was ever good enough and if I didn’t jump to attention over any tiny thing they flipped. They sent so many aggressive emails but we were expected to ignore the aggressive tone. We were told we couldn’t use anyone we know to do work on the house which makes it difficult when you know a great deal of people! Sorry for being sociable your majesty! The builder we used to fix a few small problems has a masters degree but oh no that’s not good enough because we know him.
We even had complaints about a wooden floor board that had a 1 cm hole in the corner of the room behind the television so we replaced it and then had demands that the shade of wood was 2 shades darker than the original wood !!
Non of these people even understand the science behind condensation created by cooking, drying clothes inside and bathing. I tried explain logic but they interpreted that as telling them not to cook ???? !!!!!! Learn how to ventilate your homes people because it doesn’t matter if you’re renting or you own a house condensation management is required for all homes and if you don’t understand what that entails or the difference you will forever blaming someone else! The website itself cares little for the effects on other humans when untrue reviews are left. It’s all about bullying and spite. Them against us! They have all the houses and we don’t when half the time that is not true !!
I’ve sold my only house after this incident I couldn’t cope anymore so mission accomplished Jack Windle! Hope you enjoy renting houses from Black rock and John Lewis!

Finally a site like so exists for Londoners

I am.so happy to finally.find a site like this. And I hope it gets more exposure. I posted a review yesterday with my horrible landlord experience, attached evidence. Understandably the letting company see it might try to pursue a legal case of defamation. I would be 100% willing to stand with the site owner as all.my.evidence is documented. Wish me luck in my compensation claims. 😊

Advice for all victims of defamation

I would like to give some practical advice for addressing cases of defamation for victims as there are some misconceptions and as a result some are unaware of how to remove defamatory content. We are all well within our rights to have any defamatory content removed.

In addition, if tenants have genuinely suffered from a landlord mistreating them, there are several regulated, legitimate and free ways to address the issue (such as tenancy deposit scheme, local authority property licence, citizens advice etc.) as opposed to a bitter individual spending their spare time seeking out an unregulated obscure dark review site. The argument certainly holds more weight going the legitimate routes.

1 – Firstly this site (marksoutoftenancy.com) is run by one man whom of which does not appear on the Law Society’s web site as a practicing solicitor. As a result all reviews are judged only by this individual for breaches of defamation despite not being legally trained or qualified on the specialist subject of defamation. This may mean a legally trained eye (or otherwise) can easily spot evidence of defamation currently published on this site, for the sole reason the landlord has not noticed it.

2 - The website requests that if any reviews that contain defamatory content are seen, this should be brought to the attention of the site owner in a specific format. He advises that he will not accept any report of defamation unless it is presented in his specifically stated format. This is incorrect – there are no requirements in UK law that require the request to be sent in a specific format in order to report cases of defamation. You can report this in any way you wish, so do not be told otherwise.

3 – In UK law, the specialist area of defamation makes very clear that it is not only a poster of defamatory material that can be held responsible, but also the owner of the web site that publishes the defamatory material holds equal responsibility. Therefore even if a review site does not publish the name of the poster – this is irrelevant – as if a web site publishes defamatory content the web site owner is equally accountable and as such can be individually pursued on the matter as it is an offence the web site owner is committing.

4 – Most landlords have insurance cover for their let portfolio, this usually contains free legal costs. Make sure this covers cases of defamation. If it does you usually have around £1 million of legal cover in order to take action against defamatory posts. It is well worth doing as it is obvious some sites overtly publish defamatory content (usually by poor quality tenants whom have openly breached their tenancy agreement but in some twisted way feel it was the landlords fault and as it is the tenants that are in the wrong they are unable to take the numerus legitimate ways to pursue the landlord) and also in some cases the review sites even try everything they can to resist taking the content down when politely asked. So well worth pursuing the legal route with specially trained legal specialists in order to eradicate sites that are complacent in publishing defamatory content.

5 – Rather curiously, it is worth noting that the site owner of marksoutoftenancy does not contact the landlord should a review be written about them. One would have thought in order for reviews to be fair the accused should have their equal right of reply. To me there is no other reason this is done like this – for the site owner to retain as many one sided reviews as he can. Please be aware of this and watch your back.

If you have found you are a victim of defamation I wish you all the best in finding justice and I hope you find the information I have posted as helpful – you do not need to suffer the law is here to protect you so do not give up and accept illegal behaviour.

I was shocked that someone wrote bad…

I was shocked that someone wrote bad review claiming I am a bad landlord, never heard about the person. Property address mentioned has nothing to do with me. This site is a joke and should be taken down. Fake reviews, fake news. Fake owner.

“A neutral review platform ….” ???

This website claims to be “a neutral review platform” but seems to be used by vengeful tenants to malign their landlords. Tenant reviews are put on the site seemingly without any verification. The owner of the site makes it extremely difficult for landlords to respond to lies, and will not take down false reviews even when proof of lies is provided.
“Marks out of tenancy” - a one star rating is over generous.

Untrue revengeful slander site

This is a shocking abuse of personal data and a portal solely set up for tenants to slander and make false allegations about landlords. Generally they are bad tenants taken to court and lost so use this site as a revenge platform. The owners of site should be prosecuted

Rude, one-man band operation with fake reviews

I found site owner doesn't reply or just writes back with an unprofessional message. He does not comply with "Guidance on Section 5 of the Defamation Act 2013 and Regulations". The owner's name can be seen at Companies House as the director of Marks Out Of Tenancy Ltd and then you can find out more about him by google searching "review of [his name]". When you check Marks Out Of Tenancy Ltd and his other companies on the Companies House website you will see his many companies have all had overdue accounts and confirmation statements, which is actually a criminal offence. I think this says a lot about how the company is run and its future. Please stay away, even if you are a tenant, as no-one should get wrapped up with this business.
