The reviewer engaged Proserve Limited to serve court proceedings on behalf of a third party. The court proceedings were served on the recipient in a timely manner.

We were provided with two addresses for service, four attempts were made to serve the court proceedings. We then attempted to communicate via email with the reviewer who failed to respond to our request for his delivery address.

This reviewer failed to follow the directions and instructions from the New Zealand Family Court. We attempted to make this clear to the reviewer, he became hostile and used offence language (please also refer to his other reviews on Trustpilot).

Please note:
It is not the role of the process server to file this matter with the Family Court, this must be completed by the applicant. The role of the process server is to locate and serve the documents, swear or affirm an affidavit of service and return the affidavit of service to the applicant (not the courts).

Facts:

1. Documents received on 3 July 2023.
2. No affidavit of service was included with the documents.
3. 4 attempts of service were made to serve the documents (we guarantee 3 attempts - no extra fee was charged to the reviewer for the additional visit).
4. Two addresses were visited for only 1 fee (no additional fee charged to visit the second address).
5. The two service addresses provided are located in a region of New Zealand not a major city.
5. The documents were served on the recipient on 11 July 2023.
6. The affidavit of service was sworn by the process server on 15 August 2023.
7. We sent an email to the reviewer on 18 August 2023 requesting a delivery address with no response (it's our policy to courier not post affidavits at our cost).
8. We received a response via email from the reviewer on 23 August 2023 asking why the Family Court had not received our affidavit and the application (this is not the role of a process server).
9. The affidavit sent via courier to the reviewer.
10. A full refund was provided to the reviewer despite his aggressive behaviour and offensive language.
11. At no time did the reviewer call or email Proserve requesting an update on the status of the affidavit of service.

We regret there was a delay in swearing the affidavit as the process server was unwell and not physically able to swear the affidavit (including a period of isolation). We have been serving legal documents, court proceedings and dissolution of marriage (divorce) applications since 1987. We have never received a negative review on any forum or website regarding our service.
