Breach of contract
Subject: Formal Complaint - Breach of Contract - Tour Date: April 16, 2025
Dear Saharansky Management,
I am writing to formally complain about a significant breach of contract regarding the "4 Days Tunisia Discovery Private Tour" that we booked on March 14, 2025. Our booking was for two adults, scheduled to commence on Wednesday, April 16, 2025, as detailed in your booking confirmation. We paid a total of $2,008.85, with an initial payment of $1,004.85 on March 14, 2025, and the remaining $1,004.00 on April 1, 2025.
According to the tour details available on your website, the inclusions clearly stated: "Professional Licensed Guide." However, we were informed by one of their workers (C.M) only on Tuesday, April 15, 2025, the day before our tour was due to start, that a family issue prevented our assigned guide from accompanying us.
As a result, we commenced our tour on Wednesday, April 16, 2025, without any professional licensed guide, despite having paid a substantial amount for a guided tour. While the driver provided some basic explanations, this was not equivalent to the service of a professional licensed guide, which was a key component of the contracted tour. In fact, at the Mides Canyons, we were even offered to pay additionally for a local guide, which we refused as we had already paid for a tour that included a guide.
Furthermore, the inclusions also specified "Complimentary Bottled Water during all the tour." Contrary to this, we were only offered one small bottle of water initially, and subsequently had to purchase our own water throughout the remainder of the tour. While the driver was generally correct, this did not compensate for the lack of a professional guide and the discrepancy regarding the provided water.
The lack of proactive communication and the need for us to constantly follow up with one of their workers (C.M) prior to the tour was also unsatisfactory (captures of emails attached below).
However, the most significant issue remains the absence of the professional licensed guide, which we believe constitutes a clear breach of contract. At no point were we offered any form of adequate compensation for this significant omission, such as a complimentary upgrade to our accommodation or the provision of local guides at each attraction.
We believe that the service provided was not in accordance with what we contracted and paid for. Therefore, we formally request a fair and appropriate compensation for this substandard service and the breach of contract.
We have written down twice to the company leader, and we have not received any answer so far.
