Notice of Intended Regulatory and Payment Protection Action
Before I take further action, I am providing you with one final opportunity to resolve this matter by issuing a full refund of CAD $133.00.
I have been informed that your business practices may be in violation of Canada's applicable laws governing the importation and distribution of regulated drugs, including the Food and Drugs Act and the associated Food and Drug Regulations, by manufacturing, packaging, labelling, exporting, or distributing products that do not comply with Canadian legal requirements.
Accordingly, I hereby demand a full refund of CAD $133.00, as the product cannot be legally imported into Canada and I have been deprived of the benefit of my purchase.
If this matter is not resolved immediately, I reserve all rights available to me, including the right to report this matter to the **Canada Border Services Agency Border Information Service (BIS), the Health Canada Border Centre, and Health Canada for investigation into your business practices relating to the export of prescription drugs into Canada and any potential non-compliance with Canadian legislation and regulatory requirements.
I have retained all relevant documentation supporting my claim, including purchase records, payment confirmations, shipping records, customs documentation, and all correspondence between the parties. This evidence will be provided to the appropriate regulatory authorities, financial institutions, consumer protection agencies, and, if necessary, any tribunal or court.
Furthermore, IndiaMART bears responsibility under its advertised Payment Protection program to assist in securing a full refund where a transaction cannot be completed as represented or where the goods cannot be lawfully delivered to the purchaser. I therefore expect IndiaMART to fulfill its obligations by facilitating and securing the immediate reimbursement of the full CAD $133.00 paid for this transaction.
This letter constitutes a formal demand for reimbursement and is made without prejudice to any and all rights and remedies available to me under applicable law. Should this matter remain unresolved, I will pursue all available remedies without further notice.
Please be advised that I am also forwarding a separate email regarding a similar matter involving another seller on your platform who currently owes me CAD $230.00. That transaction likewise remains unresolved despite my repeated attempts to obtain a refund. The existence of multiple unresolved disputes involving sellers operating through your platform raises serious concerns regarding the effectiveness of your Payment Protection program and your oversight of sellers conducting business through IndiaMART. I expect both matters to be investigated thoroughly and resolved promptly, including the recovery of all funds owed to me.
