I bought my "Kitchen Aid" Kitchen Machine from ComTech and they should send it to Sweden. When I received it, it has an error in the painting, and the start/stop button did not work.
Then I wanted to deliver it back, and if comtech were following the European purchasing law, they would give all my money back, also for the shipping back to Germany...but they did not. I got the money for the machine, but they said that they only will pay back the money for shipment within Germany, and this is against the law, but they don´t care.
So...if you live outside Germany, don´t order from this company, thats my advise.
I have started a case and have send my case to "European Consumer Centre", and they answered:
"Based on information in case we have understood that the product was defective and that you pointed out the lack against the seller and abolished the purchase. When you raise a purchase, you are treated as if the agreement was not reached. It is against this background our initial assessment that the seller should refund the costs you have incurred in connection with trade. The seller should therefore also cover your shipping costs.
Based on the foregoing, we believe that it would be appropriate to forward your complaint to our German sister's office. They will first examine whether there is a remedy in Germany that you could use. Is there a complaints in Germany that can handle your case, our sister office trying to contact the seller to resolve the matter."
If a company have choses to deal with customers in other countries, they better should know the european purchasing law before they go into that kind of business. The shipping amount isn´t that big, but right should be right, and I don´t accept that a company like Comtech will get on with this, and just keep ignoring me, when I am telling them about my rights.
So now I am looking forward to see if Comtech just will ignore the European Consumer Centre as well.
