The Managing Agent which refuses to provide any evidence it was ever appointed
The issues raised in this review are entirely factual and based on documentary evidence.
For years now, myself and other residents on my development have been embroiled in a merry-go-round with Gateway which persists in sending invoices despite refusing to provide evidence of its lawful authority to do so.
On each invoice / letter, Gateway states that it acts on behalf of our Resident Management Company (RMC) - despite simultaneously confirming in writing that it has never been appointed by it. Furthermore, such an appointment would be contrary to residents transfer deeds and planning permission governing the development.
Gateway have been appointed directly by developers Redrow and Linden Homes (Vistry.) This is an established fact.
Despite the Local Authority confirming in writing, that the developers remain responsible for maintenance, Gateway continue to send invoices to residents whilst claiming to act on behalf of the Residents Management Company.
They have ignored repeated correspondence from residents simply requesting transparency and a simple contact under which they are empowered to act. They have refused for years.
So far, circa £500,000 has been taken from residents through alleged 'estate management fees' despite the responsibility for maintenance sitting firmly with the developers.
It seems that everybody benefits from the arrangement other than residents.
Gateway has taken out insurance policies in the name of the Resident Management Company despite it not owning any land and despite not being appointed by it.
In so doing, it has earned thousands of pounds in commission by administering the policy through its sister company in the Gateway Group which shares the same office. There is clear documentary evidence showing this to be the case.
To date, Gateway has ignored solicitors letters asking for it to provide this evidence.
It has sent multiple letters before action speaking of an intention to instigate proceedings - but no proceedings have ever been instigated (despite the first letter of its kind being sent over a year ago.)
Most recently, I wrote to Gateway (as per civil procedure rules when a company claims you owe them money) and asked for a number of documents which a lawfully appointed Managing Agent should provide to legitimise its appointment.
This isn't optional on Gateway's part - its a prerequisite before instigating proceedings.
Not only did Gateway fail to provide the required documentation, it actually put into writing that it would not comply.
More and more people are now not paying - especially since Gateway has informed residents that it will recoup costs for those not paying, from those who are. This is also not allowed under the terms of residents' transfer deeds. But this doesn't stop Gateway.
My advice to anybody receiving invoices from Gateway - ensure you are satisfied that there is a lawful appointment and that the charges are legitimate. If you are in any way unsure, you should take advice.

Worst of the worst
Worst company I have ever had the displeasure of having to deal with. Hidden costs everywhere, primitive payment options and excessive charges. We are prisoners. Avoid like the plague.
Poor company, great staff like Naomi
Gateway itself is a pain of a company to deal with - imagine bringing 2 bills due in the same month without any consideration. Either lack of empathy or lack of organisation or both. But thank God for staff like Naomi, who has some humane mind and handle issues professionally.

This afternoon, I spoke with Rosie Croud estate manager at Gateway. Concerning an ongoing four year problem which needs to be addressed .She was very understanding and considerate towards me. She gave me reassurance that things would be dealt with promptly. She spoke kindly to me and sent me a pleasant reply.

Absolutely disgusting.
