I Was Scammed While Trying to Protect My Work: Xpress Mark Must Be Investigated

I don’t even want to waste more time on this, but people need to know.

Xpress Mark scammed me. Plain and simple. I was just trying to protect something I created—something personal, meaningful—and they used that against me. It started with a decent-looking price, then turned into hundreds, then thousands of dollars with pressure and scare tactics. They made it sound like if I didn’t keep paying, I could lose my trademark or get in legal trouble. None of it was real.

They promised filings. I got no proof. No follow-up. No clear service. Just invoices and stress. When I pushed back, they went silent. No refunds, no accountability.

I’m not the only one. There are many others saying the same thing. This isn’t just a bad company—it’s a business model built on misleading people at vulnerable moments.

If you're thinking about using Xpress Mark, don’t. Go directly through the USPTO or work with a real trademark attorney. These people aren’t legit, and the peace of mind they sell you is fake. I even made a petition about them on change.org because of how frustrated I am by their "rules don't apply to us" business tactics. This happened to me in June of 2023.

Xpressmark is a SCAM!

Xpressmark first took it upon themselves to decide that I needed 3 classes instead of just one, even though they don't apply to my product. They charged $1,050 up front for that. They wait long enough so you can't contest with your credit card. Then they proceed to ask for more money for an attorney to examine the deal. That was another $1,199 (I was able to get that fee reduced to $899.) Again, they wait until you can no longer contest the charges with your credit card company and then state they need an additional $4,350 to "complete the trademark." It was at this point that I grew extremely suspicious. I asked for their address. They gave me a New York address even though their original address was from Texas. I reported them to the New York crime task force and they determined that the address was fake. They again asked for money and I explained that I knew it was a scam and New York task force confirmed the address was bogus. They stopped messaging me after that.

Scam scam scam

It’s such the harassment after only researching. They’ve been calling, sending e-mails and text stating that someone wants to register my brand for over a year. I’ve read all the reviews and won’t fall for the scam. Fortunately I haven’t given them any money and I won’t.

Seems to me scam or fraud

Make sure you understand the total cost upfront. This company advertises a price for acquiring a trademark, then proceeds to demand additional fees that were not originally disclosed. A representative forced me to pay, telling me that I had 72 hours. Then they called and said I needed an attorney right away. By mistake, I paid twice. Now, I've been waiting four months for a refund for the fee I paid by mistake. Every time I call them, I get the same story.
Their representative will even go as far as to say that if the Trademark application is abandoned, you can no longer use your company name, and pressure you about final notices (They helped me apply in august of 2023, and in march of 2024 made it seem that I had to pay them immediately

Their representative will even go as far as to say that if the Trademark application is abandoned, you can no longer use your company name, and pressure you about final notices (They helped me apply in November of 2023, and in April of 2024 made it seem that I had to pay them immediately (you have six months).

I paid 1400 for a trademark for…

I paid 1400 for a trademark for Metropolitan HVAC LLC last year, and this company completely scammed me out of my money. They do not respond, and the call centers and addresses listed are all fake addresses.
My bank has even reached out and will reverse the charge after they won a dispute. I don't know how they won. They never produced on the contract nothing was filed no work performed take your money and run.

They just take your money and do not respond

They forced me to pay for three trademark classes, claiming that my application wouldn't be approved otherwise. However, they filed for only one trademark class, and it was the wrong one, which is not usable for me at all (this was verified with another lawyer). When I reached out to them, they started making up stories and are not even responding to my messages or emails.

Stay away from them. They never do anything on time and just lie to you. My $1,300 is down the drain, and they don't even respond. I wish I could share screenshots of their messages.

Excuse after Excuse

I paid for the expedited service to receive my serial number in 7 days. That was on Sept 28th. It is now November 5th and every time I email them, I'm given some random excuse and told it'll be next (week, day, 24 hours). Don't really know what I paid for.

Amazing and affordable trademark company

Because of all the fraud, I had no trust in anyone who claimed to file a proper trademark. Let me save you time and research. Let’s say you have a lifelong best friend and his expertise is trademarking… that’s exactly who Brandmark Protect is. There were plenty of opportunities to just file my trademark, but Brandmark took my best interests at heart and did an amazing job. 10+ stars if it were possible. The best part? The affordability.

Since I decided not to work with them, they are now threatening to TM my name for themselves if I don’t use them. Please stay away from these scammers!

The people at Xpressmark are crooks

WARNING!!! The people at Xpressmark are crooks. They took my money and will not issue a refund. Please file a claim with Texasattorneygeneral.gov and with IC3.gov, this is the internet crimes unit. Xpressmark charged me $2388 to file my name and logo. $288 for search and $2100 to file 3 classes for my name and 3 classes for my logo, a total of 6 classes. They informed me the filing fee for each class was $350. They only filed 1 class for $250. That one filing was done incorrectly. They only filed something when I threatened to file a claim and I waited weeks with no update nor proof of filing.

They send you information to make it seem like they are a legit company, but they are legit scammers. Do not fall for it. I have proof of how they fabricated communication to my bank. Go and hire a real attorney as this company is not authorized to file on your behalf, only an attorney can, which they are not. You will have a hard time disputing a claim you authorized if you chose this company.

They took my money and refuse to issue a refund. They sent me an email months later stating that filing fees are non-refundable. Filing fees that do not belong to them, filing fees that they collected to file with the USPTO???

I will file a claim with every agency until these people are stopped. Don't believe the positive reviews. They are fake!
