Item not as described. Seller unresponsive.

I ordered a Samsung Galaxy S22 Ultra (green, 512GB, very good condition) under eBay item number 257128483159. Unfortunately, the phone I received was a different colour (black) and clearly not the advertised condition — it had visible scratches, dents, and dirt.

I first contacted the seller on 25 December and sent multiple messages, including clear photos of the phone received. The seller responded once on 25 December and asked me to wait until 4 January because their dispatch team was unavailable. They assured me they would be in contact to explain what happened and why I received the wrong phone. I replied immediately, but then heard nothing further. I followed up again on 7 January and received no response.

On 9 January I followed up again and finally received a reply. The options offered were disappointing — I was told to either wait for “management” (who would not return until 19 January) or accept an $80 partial refund, with no explanation for why the wrong phone was sent. Since then, despite further attempts to resolve the issue, I have had no communication at all. It appears the seller has stalled until eBay’s return timeframe has passed. However, because the issue remains unresolved through no fault of my own, I am still covered under Australian Consumer Law.

As of 23 January, I have sent additional messages on 16, 22, and 23 January and the issue remains unresolved. I still have an open return case and am now pursuing resolution through eBay under ACL rights, as well as other Australian consumer protection channels including Fair Trading and the ACCC. I hope this can still be resolved, but based on my experience, my trust in this seller has been lost. Buyers should proceed with caution.
