Illegal refusal of valid withdrawal - o2 ignoring § 355 BGB
I am writing this to warn other consumers about the deceptive practices of o2 (Telefónica Germany).
I revoked my DSL contract within the legal 14-day window on Jan 5th, 2026. Despite having written proof of this email sent before their own deadline of Jan 6th, o2 continues to ignore the law.
Their support staff (specifically Mr. Heilenmann and G. Radymski) have repeatedly claimed that a withdrawal MUST be done through the broker (Check24). This is legally false under § 355 BGB, which states a consumer can revoke directly with the contract partner.
Even after providing a registered mail tracking number (RT287880093DE) and their own letter from Jan 7th acknowledging my request, they continue to attempt unauthorized debits from my account.
I have now filed an official complaint with the Federal Network Agency (Bundesnetzagentur) under case number 2026-02-11-0091.
Prospective customers: Beware. o2 will try to trap you in a "loop" between them and the broker to prevent you from exercising your legal rights. I will continue to reverse every unauthorized charge they attempt.
