Warning: "Pay As You Go" Contract Contains Potentially Void Class Action Waiver (Clause 18)

I am writing this to expose a concerning legal tactic PenguinPickUp uses against Ontario consumers. Even for simple "Pay As You Go" transactions, users are forced to sign a document titled "Subscription Agreement" to access their parcels.
The Issue:
Hidden in the fine print is Clause 18, which demands that customers "waive any right you may have to... commence or participate in any class action."
Why This Is Deceptive:
While they explicitly exclude Quebec residents from this clause (because they know it is strictly illegal there), they attempt to force this waiver on Ontario residents. However, under Ontario's Consumer Protection Act, 2002, clauses that force consumers to waive their rights to class proceedings are generally void and unenforceable.
It appears PenguinPickUp includes this clause not because it is legal, but to intimidate customers into thinking they cannot sue if the company loses or damages their property. This is a "bullying" tactic designed to silence consumers.
Verdict:
Use this service if you must, but be aware that Clause 18 is likely a "paper tiger." Do not let their user agreement fool you into thinking you have signed away your statutory rights.

Purolator drop-off in Sudbury

I recently used the Purolator drop-off at 2008 Lasalle Blvd inside Learning Beam Academy and had a great experience. NJ was very friendly and efficient. Everything was handled professionally; he even helped lift my box from my car. He made sure my package was taken care of right away. This is definitely my go-to spot for Purolator drop-offs from now on.

I was charged over 200 $ for a letter…

I was charged over 200 $ for a letter to be delivered from Canada to the UK. As the letter contained a credit card that my daughter had lost and urgently needed replacement, I paid the hefty fine. I was even encouraged to pay 367$ for next day delivery, but had to decline as it was financially unfeasable for me. The letter, 48 hours later was never delivered. I spent countless hours trying to reach FedEx. My daughters trip had to be cancelled. They card arrived 10 days later! Fed Ex is not claiming responsibility, stated that all letters and parcels are redirected to the US for customs clearance. If this is the case, why are Penguin and FedEx offering next day delivery and 48 hour delivery? Where is the transparency? Why are clients not informed? I am waiting for Penguin to respond.

I see they treat people with disabilities horrible customer service rude and ignorant customer service

This is the danforth pick up No more bull shot because of Canada post strike. Thank you for nothing but a pain in the ass hole

PenguinPickup - 650 Dundas Toronto - incompetent

PenguinPickup staff at 650 Dundas st E in Toronto are completely incompetent. On Aug 4, I told them I needed to get a letter to Newfoundland in less than a week. They told me they will have it delivered on Aug 7 via FedEx & charged me $52. On August 8, they had not yet even given the letter to FedEx. My package got to NL a week late. My recipient was no longer there. Had to pay another courier to get it to her. Now PenguinPickup staff refusing to refund my money - staff now lying, actually blaming me, lying by saying they presented different options & I could have chosen a different option. Lying to cover incompetence. They did not present any options. I would have paid any amount of money to ship that package. Shameful.
