Court Revives Lawsuit Accusing Webloyalty Of Bilking Consumers

A federal appellate court has revived a lawsuit accusing Webloyalty of duping Web users into signing up for a paid membership program.
In a ruling issued Tuesday, a three-judge panel of the 9th Circuit Court of Appeals said that California resident Kevin Park could proceed with a class-action complaint alleging that Webloyalty violated a law regarding the transfer of electronic funds, as well as laws regarding unfair business practices.
The battle centered on allegations that Webloyalty used "data pass" marketing -- which occurs when online merchants forward consumers' credit card data to post-transaction companies that then enroll consumers in paid programs.
Park alleged that after he bought a gift certificate for his son from Gamestop.com in 2009, he saw an ad for a $10 coupon from the company. He alleged that he clicked through and entered his email address, without realizing that he was signing up for a paid Webloyalty program. Two years later, he realized Webloyalty had charged him $264, according to court documents.
A trial judge dismissed Park's claims before trial, in part because Webloyalty presented documents appearing to show that it disclosed the terms of the membership program to Park before he enrolled in it.
Park appealed that ruling to the 9th Circuit. On Tuesday, that court sided with Park, ruling that the judge shouldn't have accepted Webloyalty's evidence before without giving Park the opportunity to challenge its authenticity and accuracy.
In 2010, Congress passed the "Restore Online Shoppers' Confidence Act," which imposed new restrictions on post-transaction marketers who offer Web users the chance to enroll in discount clubs immediately after making e-commerce purchases. Among other curbs, the measure prohibited post-transaction companies from charging consumers' credit cards unless the consumers re-enter their entire card numbers as well as their names and addresses. The bill also prohibited online retailers from disclosing consumers' credit card information to post-transaction companies.
That same year, Webloyalty agreed to pay $5.2 million to settle a New York state investigation into allegations that the company tricked users into registering for paid discount clubs. Five online retailers, including Orbitz and Shutterfly, also agreed to pay a total of more than $3 million.
Affinion, a former competitor, subsequently acquired Webloyalty. In 2013, Affinion agreed to pay $30 million to settle charges by attorneys general in 46 states.

excellent value if you know how to use SD&R (and it's not hard!)

I have been a member for several years and am happy to continue to use SD&R. It costs £10/mth but this is paid back if you only make one online purchase.
Anyone leaving a bad review here probably didn't read the small print and weren't aware of what they signed up for. Membership is not automatic but requires you to click and provide payment details. It's beyond me how anyone can sign up and then moan, just because they didn't understand how the scheme works.....

Claiming the monthly £10 back is easy and I like receiving 10% cashback on booking.com, hotels.com, Screwfix, B&Q, Wilko, Argos, M&S, eBay, Adidas, etc.
My savings from cashback are nearly £1,000 and I make a point of clicking through the SD&R website for every hotel booking, rail tickets, and major purchases.
Only a small number of the big name retailers don't participate and I use TCB or Quidco for these.

SD&R are not perfect and I sometimes have to chase up missing cashback. Their c/s is based abroad but communicate reasonably well via email, so not a huge problem. Their service has improved markedly from 2-3 years ago, when it was patchy and I nearly gave up using them.
The REALLY annoying thing about their c/s is the inconsistency: you never get the same result/resolution, which shows their staff are just poorly trained.

For anyone regularly using giftcards, the 20% discount on certain high street names is useful, eg Arcadia, Argos, etc (SD&R: PLEASE get the Boots card problem fixed!). It would be nice to get a bigger selection of these, eg B&Q, Wickes.

Shocking just shocking.

Shocking just shocking.
I have been charged GBP 8 monthly for at least the last 6 years yet I NEVER signed up for any membership. When I contacted Shopppersdiscountsandrewards via email they said that they had no record of my account so I have no idea why my American Express account would have paid this corporation for over 6 years.
Now when trying to contact Shoppersdiscount on 0800 731 9935 the number no longer seems to work and no one has replied to my last email dated 31/07 so it's all incredibly frustrating.
If I do not hear from the company directly in the next 2 business days I will go directly to the Financial Ombudsman as my first email to the company inquiring about why I was being charged when I never signed up to anything was in April 2017 so considerably more than 8 weeks ago

You can get your money back

You can get your money back but be prepared for a slow process.
1st: Cancel the direct debit immediately at your bank and ask to be put through to card fraud dept. Explain the unauthorised debits to them and supply any evidence they may require, in some cases they may be able to refund up to 14 months and claim it back directly from shopperdiscounts.

2nd: Contact them, Call: 0800 731 9935 (Mo​n - F​ri 8a​m - 8p​m, Sa​t 9a​m - 4p​m), tell them why you wish to cancel(eg. wrongfully signed up)and that you have cancelled future withdrawals from you account and require a full refund minus any monies returned to you from your bank. Inform them that you will be keeping copies of all correspondence with them to pass onto Trading Standards and Solicitors should you not receive a satisfactory outcome and full refund. They will need information re the account which you need to start the refund process, this includes account holders id number(which you probably wont have), name, email address and bank details. They will offer an immediate refund of 3 payments and send you claim form(email with information not an actual form) to have balance refunded, reply with the relevant answers, it would be advisable at this point to give them your International Bank Account Number(IBAN) this is needed for international money transfers and can be found on your statements or from your bank. I didn't know about this at the beginning of my claim and it slowed down my own refund which was quite frustrating as they would already have had that information in the first place to obtain money from my UK account.

It will seem like a long drawn process with obstacles being put in the way such as a 5/7 working day wait for each email response time and 7/10 working days for monies to appear in your account also the information on how you you would have had to jump through hoops to complete enrolment onto their scheme, which, if like me you had know idea how you ended up being duped by a third party company not even related to the original purchasing company of your transaction. I am happy to say that after 3 long frustrating months I eventually received a full refund totalling £1,000.00+ back into my bank account, so persevere and don't give up, this is your money and your are fully entitled to get it back no matter what.

Similar to everyone else

Similar to everyone else. i noticed that shopperdisc had been taking £10 from my account for god knows how long, over a year though i cant be sure due to my online bank only providing 12months of transactions. Contacted shopperdisc who then stated they had no record of me and then asked me to share my bank details!! Contacted my bank to block shopperdisc and and have given all the details to the financial ombudsmen.

Unacceptable experience.

Unacceptable experience.
Today I have just realised that this company (still dont know who they are but I will find out), they were taken from my account each month since 2009 £10. That is a LOT of money . I never noticed because £10 is easy to miss when you are shopping often.
I never wanted to subscribe. They were explaining something that is related to Wizzair etc.... . How they can set up a direct debit just like that without my knowledge. I am furious. Obviously this a scam!!! How can this happen? I have asked a refund, so far no answer.
I will not leave this money for them.
Shame on them. So many victims.

Be aware!

I mistakenly clicked on a 'would you like a voucher on your next order' offer when checking out of lookfantastic . com. There was no mention at all of a commitment to recurrent payments from my credit card.

That was in October 2014 and ever since, this company has been charging £15 a month to my credit card for no good reason at all.

The single email / communication that mentions payment - only mentions it very deep in the small print - which any reasonable person could be expected to miss.

I asked Customer Services for a full refund only to be told they would only refund 3 months payments. This has still left me ~£270 out of pocket even though I have never accessed the site, benefited at all or was even aware payments were being taken.

I have changed the rating from 1 to 2 stars as Mary finally sorted this out for us. Thank you Mary.

No reply to complaint email!

Found out by chance that I have also been caught out by this scam. Despite several emails to Shopper Discounts Customer service department, I have yet to receive a reply. £10 a month dating back to July 2014! I will give it a few more days before taking the matter further.

Beware

I have just found out that for at least 4 years I have been paying Shopper Discounts and Rewards £10 per month. They have been claiming this directly from my credit card. Apparently 4 years ago I purchased something from JD Williams and I was asked if I wanted a voucher I don't know if it was against that purchase or future purchase and because I said yes I somehow got into paying this £10 per month. The thing is JD Williams is a web based shop that offers numerous vouchers and discounts. I have never had any contact with this company from 2012 until I discovered this payment so they have had approx £500 from me for nothing. I have received three months refund and have submitted paperwork for full refund. I have shared my experiences with Action Fraud and if I don't receive a full refund I fully intend to take this matter to the small claims court. If I signed something it would have been because it is misleading because I would never be involved with some sort of cash back scheme. Please exercise extreme caution.

Deducting money from my account without my knowledge!

They have been taking £15 off me every month for a year now. Didn't notice until today what this shopperdisc.co.uk was. Hoping to get a full refund. I have no idea what the company are or what they do. Apparently ticked a box when ordering a card from funky pigeon. NOT HAPPY. Good customer service

I have had an account for many months and it has been absolutely fine. I have received a lot of the benefits as described. I had a problem with my account but it was resolved to my satisfaction. The cash back rates are excellent and I would highly recommend the service. However, you need to be disciplined and ensure you claim your monthly bonus cheques and then make sure that you always search the shopper discount website before you buy anything to take maximum be fit from the membership. I have earned £1600 cash back over the last few years. So well worth it.

Fraud

Took money from my account without authorisation!! Disgusting
Would prefer to give 0 stars but not option!

I am updating my initial review as the total amount that had been taken from my account has been refunded in full. The response from Mary was very professional and her response prompt. I am glad that the problem has been resolved but aggrieved that this took place in the first place. I have updated my star rating to 2.

deduction from my bank account

This is something ridiculous. I didn't signup for any shopper disc.co.uk from past two three months 15 pounds is getting deducted from my account without any permission or knowledge is this the correct way. 30 pounds is huge amount for me. i need my full refund back. this is not at all fair and i didn't register or signed up for your company nor do i have the membership. I NEED MY MONEY BACK.
i am not even in UK now . what to do to get my money back.

Great if you know how to save

it's easy to save money using shopper discounts and rewards if you know how to. make the most of the giftcards (20% off) and also the 10pc cashback on the site - you can go to boots and halfords and loads of popular sites you would prob normally use anyway. yes there is a fee but even that is covered by the monthly bonus. you do have to be organised though and claim the bonus each month by emailing. it's generally easy to use and i've saved quite a bit of money.

Discusting!

I cannot believe that I have had £10 a month taken from my bank account since November 2011! £440 in total for nothing! I have emailed to get this DD cancel and to find out what I need to do to get a refund! I have never received an email or a letter in relation to this; they have simply and quietly taken £10 from my account every month for nothing!

Shocking

Had not even heard of this company until I see my bank statement and they had taken £15! How they got my bank account details and were able to remove money is very scary! Definitely haven't signed up to anything! Shocking and disgusting that this is allowed to go on!

Always read the small print

I have recently joined this group, only after reading the small print and understanding terms & conditions. I have already received a £30 cheque from them after sending them my receipt for a purchase I made from toys r us. Just placed an order for caravan equipment and will save about £99.

Obviously having a membership and paying £10 a month is stupid if you do not buy from their associated company's. Worth a go if you are intending to spend and can be bothered to check out the suppliers.

DO NOT SIGN UP!!!!!!

I have just found out they have taken £15 out my bank without me knowing. You get a 30 day free trial then they start taking money off you.
I have just phoned the freephone no. = 0800 731 9935. They ask for membership number which i didn't have, stay on the line as they will ask for your post code instead. I got through and demanded a refund and to cancel any subscription i didn't even know i had signed up to!!!!!!!.
I got my money back and they cancelled subscription. THIS COMPANY SHOULD NOT BE ALLOWED TO TRADE. STOP CONNING INNOCENT PEOPLE.
