We applied for a Straight to Residence visa in February 2025, and things took a serious turn when Immigration New Zealand (INZ) raised medical concerns about our 16-year-old daughter. They said she didn’t meet the Acceptable Standard of Health (ASH) and issued a third Potentially Prejudicial Information (PPI) letter, after we had already responded to two earlier ones. We knew this was our final chance to submit the right documents, or our family’s entire residency application would be declined.

My student visa was unexpectedly declined just five working days before my current visa expired, leaving me in a very stressful and uncertain situation. I didn’t have enough time to apply for a temporary visa to leave New Zealand, however other lawyers I consulted advised me to leave the country and reapply from overseas. I would like to begin this review by expressing my sincere gratitude to Simon Park and everyone else on the Immigration Trust team. Earlier this year (February of 2025) I was personally impacted by political decisions made by DOGE and the Trump administration in the United States. Without going into too much detail there, I felt as if it was no longer safe for me or my partner to be in the country for much longer, especially considering that we are openly gay and my partner is transgender. My partner even received a phone call from his health insurance company, citing a “demographic issue” in his paperwork, stating that he would need to officially register with the Department of Health and Human Services as transgender to maintain his coverage, and that was a major red flag to us both.
Speaking of healthcare, my partner has a number of chronic health conditions (including Autism Spectrum Disorder) which would ordinarily be red flags for any immigration agency if we were to apply without legal assistance, hence why we reached out to Immigration Trust in the first place. I read on their website how they specialize in difficult cases, including individuals with chronic health conditions, mentioning Autism specifically, so we booked a consultation to see if we have a solid enough case to move forward. During our initial consultation, Simon was understanding and reassuring, and we knew we were in good hands.
Beyond “escaping American politics”, we also chose New Zealand as a new place to call home because I need a postgraduate degree in order to advance in my own career, and New Zealand has high quality universities for a fraction of the cost in the United States. As such, Simon recommended that I apply for a Student Visa, and he was able to connect me to a university who not only offered me an Offer of Place, but also a partial scholarship to assist with the cost of tuition, living expenses, etc. My partner will be receiving a Partner of a Student Work Visa, which will allow him to work while I study, further contributing to our collective income and savings.
So far, the only major bump in the road came around late May/early June, when we were informed that Immigration New Zealand required more time to process our paperwork, thus making it nearly impossible for me to be able to start in July as I originally intended. Simon suggested that I defer my start date until the February 2026 intake, which I agreed to do, and that has provided us with enough time to get our affairs in order and do some traveling between now and then. We decided to keep our late June departure date and spend some time as tourists in this part of the world, because a) we wanted to leave the United States as quickly as possible, and b) several months of tourism around New Zealand and Australia is cheaper than return tickets to America.
In addition, we’ve discovered that prescription medications are also way more affordable than they are in the United States, so even though we don’t yet qualify for the free health care system, we’re still paying less than we would back home, even with American health insurance. We feel safer, healthier, and have more money in our savings in New Zealand than we would otherwise if we chose to remain in the United States. We’ve only been here for a couple of months, and every day we both feel like we made the right decision to move here and that we chose the right legal team for our situation.
